Terms of Use
These Terms of Use ("Terms") are a legal agreement between you and Fischer Interactive LLC, a North Carolina limited liability company ("Fischer Interactive", "we", "us"). They govern your use of fischerinteractive.com (the "Site") and any Fischer Interactive applications, tools, or services that link to these Terms (each a "Service").
By using the Site or a Service, you agree to these Terms. If you do not agree, do not use them.
1. Eligibility
You must be at least 13 years old to use the Site or any Service. If you are between 13 and the age of majority where you live, you may only use the Services with the involvement of a parent or legal guardian.
2. Your account
Some Services require an account. You are responsible for keeping your login credentials secure and for activity under your account. Tell us promptly at support@fischerinteractive.com if you believe your account has been used without your permission.
3. Your content
You retain ownership of the content you put into our Services (for example, the entries you log in WifePoints). You grant Fischer Interactive a limited, worldwide, non-exclusive license to host, store, process, back up, and display that content solely as needed to operate the Service for you and the people you share it with.
You are responsible for the content you put in. Do not upload content that is unlawful, infringes someone else's rights, or that you don't have the right to share.
4. Acceptable use
You agree not to:
- Use the Services to break the law, or to help someone else do so.
- Attempt to reverse-engineer, decompile, or otherwise probe non-public parts of the Services.
- Interfere with, disrupt, or overload the Services or the infrastructure that supports them.
- Use the Services to harass, threaten, or harm another person.
- Circumvent or attempt to circumvent security or access controls.
5. Intellectual property
The Site, the Services, and all associated software, designs, text, graphics, and trademarks are owned by Fischer Interactive LLC or its licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to our name, logo, or other trademarks except the limited right to use the Services as intended.
6. Fees
Some Services or features may be offered on a paid basis. If you purchase a paid feature, the pricing and billing terms will be presented to you at the point of purchase and are part of these Terms. Unless required by law, fees are non-refundable.
7. Changes to the Services
We're a small studio, and the Services will evolve. We may add, change, or remove features. If we make a material change that reduces the core functionality you rely on, we will make reasonable efforts to give you notice inside the affected Service.
8. Termination
You may stop using the Services at any time and delete your account from within the Service or by emailing admin@fischerinteractive.com. We may suspend or terminate your access if you materially violate these Terms, or if we are required to do so by law.
9. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law, Fischer Interactive disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
10. Limitation of liability
To the fullest extent permitted by law, in no event will Fischer Interactive LLC, its members, managers, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless Fischer Interactive LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any rights of a third party.
12. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will notify you inside the affected Service or by email, and update the "Last updated" date at the top of this page. Your continued use of the Services after the change means you accept the updated Terms.
